Terms of Sale

1. Purpose

These Terms of Sale (the "Terms") govern access to and use of the Advertpilot service (the "Service"), a SaaS e-commerce intelligence platform available at app.advertpilot.io, published by Benjamin de Lara (the "Publisher"), registered with the Paris Trade and Companies Register (RCS) under number 805 292 760 00032, with registered address at 25 rue du Général Delestraint, 75016 Paris, France.

By subscribing to any plan, you fully accept these Terms.

2. Description of the Service

Advertpilot lets you track and analyze publicly available information about the e-commerce market: ads running on Meta and Google Ads, products and collections, creators, brands and trends. The data displayed comes from public sources, aggregated and enriched by the Service, and is provided for informational purposes only. The Publisher does not guarantee its completeness, absolute accuracy, or fitness for any particular purpose.

3. Customer account

Access to the Service requires creating an account. The customer agrees to provide accurate information and to keep their login credentials confidential. Each account is personal; the number of authorized users depends on the subscribed plan. Sharing credentials beyond the users included in the plan is prohibited.

4. Subscriptions, pricing and billing

The Service is offered as a monthly or annual subscription, according to the plans described on the Pricing page (Starter, Pro, Business, plus an Enterprise offer available on quote). Prices are stated in euros. The Publisher reserves the right to change its prices; any change will be notified to the customer at least 30 days before it takes effect and will only apply from the next renewal.

Payment is made online, by credit or debit card, through our secure payment provider. Billing occurs at the start of each subscription period.

5. Term and automatic renewal

The subscription runs for the term selected at sign-up (one month or one year). It renews automatically at the end of each period, for an identical term, and the payment method on file is automatically charged, unless the subscription is cancelled before the renewal date.

6. Cancellation

The customer may cancel their subscription at any time from their account area (Settings > Billing). Cancellation takes effect at the end of the current subscription period: access to the Service is maintained until that date, and no further charges are made. Periods already started are not refunded, in whole or in part.

The Publisher may suspend or terminate an account in the event of a serious breach of these Terms (including account sharing, large-scale data extraction, or compromising the security of the Service), after a notice that remains unaddressed for 7 days, except in cases of urgency.

7. Plan changes

The customer may change plans at any time. Upgrading to a higher plan takes effect immediately; the price difference is billed on a prorated basis for the remainder of the current period. Downgrading to a lower plan takes effect at the next renewal.

8. Right of withdrawal

The Service is primarily intended for business users. In accordance with Article L.221-3 of the French Consumer Code, the right of withdrawal does not apply to contracts concluded between professionals in the course of their business. If the customer subscribes as a consumer, they acknowledge requesting immediate performance of the Service and expressly waive their right of withdrawal upon first accessing the Service, in accordance with Article L.221-28 of the French Consumer Code.

9. Quotas and fair use

Each plan includes usage limits (number of users, tracked brands, displayed results, API credits) described on the Pricing page. The Publisher reserves the right to temporarily restrict access in the event of abnormal usage likely to degrade the Service for other customers, in particular any large-scale automated extraction of platform data.

10. Service availability

The Publisher strives to keep the Service available 24/7, without any service-level guarantee, unless a specific commitment is provided under an Enterprise offer. Maintenance interruptions may occur; whenever possible, they are scheduled outside business hours.

11. Liability

The Service provides information for market intelligence and decision-support purposes. Business decisions made by the customer based on this information are made under their sole responsibility. The Publisher's total liability, on any grounds whatsoever, is limited to the amount actually paid by the customer over the 12 months preceding the event giving rise to the claim.

12. Intellectual property

The Service, its interface and its databases remain the exclusive property of the Publisher. The subscription grants the customer a personal, non-exclusive and non-transferable right to use the Service for their own needs, for the duration of the subscription.

13. Personal data

The processing of the customer's personal data is described in the Privacy Policy.

14. Changes to these Terms

The Publisher may update these Terms over time. The applicable version is the one in force on the date of subscription or renewal. In the event of a substantial change, the customer will be informed at least 30 days before it takes effect.

15. Governing law and jurisdiction

These Terms are governed by French law. Failing an amicable resolution, any dispute will be brought before the competent courts of Paris, subject to mandatory rules applicable to consumers.
